By proceeding, you acknowledge that you have read, understood, and agree to the Privacy Policy and the Terms and Conditions of this agreement. This document helps us ensure we're both on the same page and sets the foundation for a successful coaching experience. I'm excited to support you on your journey!
1. Scope of Services:
The Coach agrees to provide online coaching services to the Client, focusing on fitness, nutrition, lifestyle, and mindset development, as outlined in the agreed-upon coaching program.
The Client acknowledges that Carly Fry will be their primary online coach.
2. Disclaimer of Medical Advice:
The Coach is not a medical professional. The services provided are for coaching purposes only and do not constitute medical advice.
The Coach does not diagnose, treat, or prescribe for any medical conditions.
All advice regarding supplements, nutrition, training, emotional well-being, and physiology is provided as general guidance and should not be considered prescriptive.
The Client is strongly advised to consult with a qualified healthcare professional (e.g., GP, physician) before starting any fitness, nutrition, or lifestyle program.
3. Client Responsibilities:
Medical Disclosure: The Client must accurately disclose any pre-existing medical conditions or health concerns through the provided health questionnaire. The Client warrants that they have consulted with their GP or other relevant medical professional regarding their suitability for the coaching program and have been cleared to participate. By agreeing to these terms, the Client confirms they are voluntarily participating in the program and assume all risks associated with their participation, to the extent permitted by law.
Adherence to Advice: The client takes full responsibility for their own actions, and understands that the advice given is only a guide.
Communication: The Client agrees to maintain regular and honest communication with the Coach, providing accurate and timely information.
Data Provision: The Client agrees to provide all requested data, including daily and weekly tracking information, as required by the Coach.
Weekly Check-ins: The Client must complete weekly check-ins on the designated day and time.
Commitment: The Client commits to the agreed-upon coaching period (e.g., 6 months).
Honesty: The client must be honest with the coach about food intake, exercise, and lifestyle.
4. Results Disclaimer:
The Client understands and agrees that the results of the coaching program may vary depending on individual effort, commitment, and adherence to the provided guidance. The Coach does not guarantee specific outcomes or results.
5. Payment and Refunds:
All coaching fees are payable in advance.
Alternatively, a deposit and monthly payment plan may be agreed upon between the Coach and Client.
Payment Schedule: The Client agrees to adhere to the agreed-upon payment schedule.
Late Payments: Late payments may result in suspension of coaching services until the outstanding balance is paid.
Refunds: Deposits and payments are non-refundable, except in cases of proven breach of contract by the Coach.
6. Termination of Agreement:
Client Termination: The Client must provide the Coach with 28 days' written notice of their intention to terminate the coaching agreement.
Coach Termination: The Coach reserves the right to terminate the agreement if the Client: Fails to complete three consecutive weekly check-ins without prior notification. Provides false or misleading information. Engages in behaviour deemed inappropriate or disruptive by the Coach. Breaches any part of this agreement.
Please note: In the event of Coach termination due to client breach, all payments are non-refundable.
7. Limitation of Liability:
Nothing in these Terms and Conditions shall exclude or limit the Coach's liability for death or personal injury caused by the Coach's negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
The Coach shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the Client's participation in the coaching program.
The client understands that exercise and dietary changes have inherent risks, and takes full responsibility for those risks.
8. Intellectual Property:
All materials, content, and intellectual property provided by the Coach as part of the coaching program are for the Client's personal use only and may not be shared, reproduced, or distributed without the Coach's prior written consent.
9. Data Protection and GDPR Compliance:
The Coach will process the Client's personal data in accordance with the Coach's Privacy Policy, available here: Privacy Policy. By agreeing to these terms, the Client acknowledges they have read and understood the Privacy Policy.
10. Confidentiality:
The Coach will maintain the confidentiality of all client information, except where required by law.
11. Dispute Resolution:

In the event of a dispute, both parties agree to first attempt to resolve the issue through amicable negotiation.

If negotiation fails, the parties agree to engage in mediation.

If mediation fails, either party may pursue legal action.
12. Governing Law:

This agreement shall be governed by and construed in accordance with the laws of England and Wales.
13. Referral Incentive Scheme:

Clients may be eligible for a referral incentive scheme, allowing them to earn additional coaching time. Details of the current referral scheme, including the number of months awarded per successful referral, will be provided separately. To qualify for the referral reward, the referred client must sign up for and pay for a minimum of 3 months of coaching.
14. Renewal and Terms & Conditions Updates:
If the Client chooses to extend their coaching period beyond the initial agreed-upon term, these Terms & Conditions will continue to apply.
The Coach reserves the right to update these Terms & Conditions at any time. Clients will be notified in writing of any changes.
